Antoni Bolecki

INSURANCE DEFENSE

Antoni Bolecki has a broad litigation practice, focused primarily in the areas of insurance defense, premises liability, mass tort and ERISA. He is actively involved in the litigation process, representing the interests of major statewide property and liability insurance companies as well as the interests of their insureds.

Antoni handles numerous aspects of litigation, including initial case assessment and investigation as well as all aspects of discovery, motion practice, trial preparation and trial practice. He practices in both the state and federal courts of New Jersey and New York and in Europe.

He served as a judicial law clerk to the Honorable Robert A. Longhi, Assignment Judge, Superior Court of New Jersey, Civil Division, Middlesex County. He also interned with the Honorable Philip B. Cummis, Superior Court of New Jersey, Family Division, Essex County.

Agnes Antonian

ENVIRONETAL LAW

 

As Chair of Antoni Bolecki & Associates’ Environmental Law practice group, Agnes Antonian draws on her engineering background to address a broad range of complex environmental litigation and land use matters. Her environmental litigation experience spans the full spectrum of federal and state environmental law, including Superfund, the Resource Conservation and Recovery Act (RCRA), the Clean Water Act (CWA) and the New Jersey Spill Act.

Agnes represents potentially responsible parties in federal and state court and alternative dispute resolution forums regarding government and private cost-recovery litigation. Clients turn to her for advice on compliance with the New Jersey Department of Environmental Protection (NJDEP) related to hazardous substances, land use and air permitting, and on NJDEP enforcement of the associated laws and regulations. She also counsels clients facing United States Environmental Protection Agency (USEPA) enforcement of Superfund and other federal environmental laws.

Agnes understands the diverse issues companies face in developing environmentally sensitive real estate, including wetlands and coastal areas regulated by the U.S. Army Corps of Engineers (USACE). She advises owners, tenants, buyers and developers on redevelopment of brownfields and other contaminated sites covered by ISRA, as well as the business management of these projects. Agnes also represents developers and property owners in challenges to adverse rulings by state and federal regulators, including the NJDEP and the USACE.

Outside her environmental law practice, Agnes has served as local counsel on major patent antitrust litigation for global and national companies, including pharmaceutical and technology firms.

Prior to joining Antoni Bolecki & Associates, Agnes completed a judicial clerkship for the Honorable Katharine S. Hayden in the United States District Court for the District of New Jersey. She was appointed to the Supreme Court of New Jersey District Ethics Committee for Essex County from 2011 to 2015.

Agnes worked for six years for Keyspan Energy Corp. before becoming a lawyer. While at Keyspan, she managed redevelopment and other aspects of the company’s environmentally impaired properties. In addition, she oversaw Keyspan’s environmental compliance with multiple regulatory agencies.

Named one of the “Best 50 Women in Business” in 2017 by NJBIZ, Agnes has also been recognized by Chambers USA for her environmental and land use practice.

Nevins McCann

CORPORATE AND BUSINESS LAW

Nevins McCann has been at the frontline of New Jersey’s legal and political landscape for many years. From major real estate projects to high-stakes litigation, he advises clients on some of the state’s most significant and high-profile legal developments. Nevins co-chairs the firm’s Real Estate and Land Use, and Cannabis Law Groups.

In 2017, Nevins was named to New Jersey Governor-Elect Phil Murphy’s Transition 2018 team, a group of senior level industry and policy professionals tasked with analysing issues and making recommendations to the new administration. In 2010, he was appointed to Governor Christie’s transition team, assisting the administration with issues facing the state Department of Transportation and New Jersey Transit.

Nevins is a highly regarded business partner who works closely with his clients to ensure the most successful operation and outcome for their companies. With an intimate understanding of regulatory issues and a vast network of relationships, he guides clients through challenging and often sensitive issues. His experience spans multiple industries and includes counsel related to:

In the real estate arena, Nevins guides developers through all phases of the development process. With extensive experience and relationships, he assists developers in locating and acquiring parcels, entering into development and redevelopment agreements, securing all necessary site permits, financing, construction, leasing and sales. Nevins has substantial experience executing mergers and acquisitions of all sizes, as well as negotiating and drafting a diverse array of complex contracts.

Nevins also maintains an active land use practice. He has obtained permits and approvals from planning and zoning boards throughout New Jersey for more than 10,000 residential units, 10 million square feet of office space, several million square feet of retail and industrial space, and multiple hotels and fractional/timeshare residences. He also completed the development of a world-class golf course, the Liberty National Golf Club, on the Hudson River in Jersey City.

As an offshoot of his real estate practice, Nevins represents clients before federal, state and local agencies on a broad spectrum of projects, including those affected by wetlands, meadowlands and waterfront development, as well as subject to CAFRA and other regulations. Redevelopers of brownfields and other blighted properties frequently seek his counsel, particularly tax abatement advice. Nevins also assists developers in registering projects with the New Jersey Division of Community Affairs and the NJ Real Estate Commission (NJREC). He was one of the first lawyers to file a fractional/time share plan with the NJREC under the Timeshare Act.

With his office and team based in Jersey City, Nevins has had a heavy hand in guiding many of the major developments that have transformed the City of Jersey City. He works very closely with the Mayor of Jersey City, the Jersey City Council and all of the City agencies in effectively and efficiently getting the job done.

Nevins also leads the team advising on cannabis-related issues and opportunities. As a new industry in New Jersey, cannabis presents a thicket of regulatory, legal and political questions. Nevins combines his experience in all of these areas to help clients find opportunities and address new challenges. He currently serves on the board of the New Jersey Cannabis Industry Association.

Nevins is chairman of the board of the Jersey City Medical Center Foundation and serves on the board of RWJBarnabas Health Jersey City Medical Center. He is also a proud Trustee of the Liberty Science Center.

Henry "Hank" J. Catenacci

INSURANCE COVERAGE

Hank Catenacci has more than 30 years of experience advising on first-party insurance coverage and subrogation matters. Practicing in courts throughout the United States, both state and federal, Hank has handled numerous multi-million dollar insurance coverage cases on behalf of insurers and also provides consulting services to numerous clients with respect to insurance procedures and policies. He successfully defended several high profile Y2K remediation claims, as well as many complex commercial property insurance cases arising out of the September 11, 2001 terrorist attack, Hurricanes Katrina and Rita, Superstorm Sandy, and other catastrophes and large losses over the past several years.

Prior to entering private practice, Hank completed a judicial clerkship with the Honorable Robert Shaw in the United States District Court for the District of New Jersey. He attended the University of Notre Dame and the Notre Dame Law School, and has been a member of the Notre Dame Law School Advisory Council since 2011.
